# Mexico vs Colombia for US companies hiring in 2026: costs, labor law and talent

At the same USD 2,500 monthly salary, an employee costs about USD 3,312 a month in Mexico City, before profit sharing, and USD 3,459 in Colombia. Colombia already has a 42-hour week, while Mexico is cutting from 48 to 40 hours by 2030. Colombia scores higher in English (480 against 440 in EF EPI 2025), Mexico has the larger labor market, and both restrict staffing agencies: Mexico through the REPSE registry, Colombia by limiting temporary staffing to short cases.

## What does an employee cost in each country?

At the same salary in dollars, Colombia's statutory on-cost is higher. Calculated by Nearshorers with each country's 2026 rates, for a first-year employee in the lowest risk class, in Mexico City and at a Colombian employer covered by the art. 114-1 exemption, at the Bank of Mexico's FIX rate of MXN 18.7962[5] and Colombia's official rate of COP 3,182.99 per dollar:[6]

| Monthly salary | Mexico City | Colombia |
|---|---|---|
| USD 2,500 | USD 3,312 a month, 32.5% on top, before profit sharing | USD 3,459 a month, 38.4% on top |
| USD 4,000 | USD 5,280 a month, 32.0% on top, before profit sharing | USD 5,534 a month, 38.4% on top |

In Mexico the on-cost is the IMSS social security branches,[1] 5% for the INFONAVIT housing fund, the aguinaldo and vacation premium,[9] and Mexico City's 4% payroll tax,[2] with profit sharing paid once a year on top. In Colombia it is 12% for pension,[4] occupational-risk insurance,[21] 4% for the family compensation fund,[22] and the accrued service bonus, severance savings with interest and vacation;[3] the health, SENA and ICBF levies are waived below 10 minimum wages for employers that file income tax.[23]

The gap narrows over time: Mexico's employer old-age contribution for salaries above 4 UMA rises from 7.513% in 2026 to 11.875% in 2030,[24][1] which adds about 4.6% of salary at these levels (calculated). The [Mexico cost guide](https://nearshorers.com/guides/employee-cost-mexico) and the [Colombia cost guide](https://nearshorers.com/guides/employee-cost-colombia) show the line-by-line math.

## How do working hours and time zones compare?

Mexico's 2026 reform of the Federal Labor Law cuts the maximum workweek from 48 hours by two hours each January until it reaches 40 in 2030.[7] Colombia finished its own reduction in July 2026 and has a 42-hour week,[8] with night work starting at 7 p.m. and paid 35% extra.[8][3]

Neither country uses daylight saving time. Mexico City, Guadalajara and Monterrey keep UTC−6 all year,[10] and Colombia keeps UTC−5.[11] While the US is on daylight saving time, Mexico City is two hours behind New York and one hour ahead of Los Angeles, and Colombia is one hour behind New York and two hours ahead of Los Angeles. In winter, Mexico City matches Chicago and Colombia matches New York.

## How do dismissal rules compare?

The two systems price dismissal differently. In Mexico, a dismissal without a proven just cause from the closed list in article 47 and a written notice is unjustified: the employer owes three months of salary, back pay of up to 12 months if it loses in court, 20 days per year of service in the cases of article 49, and a seniority premium of 12 days per year on a salary capped at twice the minimum wage.[9][17] Any settlement must be ratified before a conciliation center or labor court.[9]

Colombia prices dismissal without cause with a formula: for an indefinite contract under 10 minimum wages, 30 days' salary for the first year and 20 for each additional year.[3] The employer must also prove it paid social security for the last three months, or the termination has no effect.[3]

## How do staffing-agency, EOR and contractor rules compare?

Both countries restrict supplying staff to another company, in different ways. Since 2021, Mexico bans personnel subcontracting and allows subcontracting only of specialized services or works outside the client's corporate purpose, delivered by a provider registered with the STPS in REPSE, and the client is jointly liable if the provider fails its workers.[9] Colombia lets temporary-staffing companies supply workers only for occasional work, replacements and peaks of up to six months plus six, and since 2025 a user company that goes beyond those cases can be declared the employer.[19][8]

Both presume an employment relationship when someone does personal work for you: in Mexico, between whoever performs personal work and whoever receives it;[9] in Colombia, in every personal work relationship.[3] The [REPSE manual](https://nearshorers.com/manuals/check-repse-registration-mexico) shows how to check a Mexican provider, and the [2025 labor reform page](https://nearshorers.com/compliance/colombia-labor-reform-ley-2466) covers Colombia's agency rules.

## Where is English strongest?

Colombia scores higher nationally in the EF English Proficiency Index 2025, 480 and 76th of 123, against Mexico's 440 and 103rd.[13][12] City scores overlap: Monterrey (532) and Guadalajara (511) in Mexico sit beside Bucaramanga (518), Medellín (516) and Bogotá (513) in Colombia, while Mexico City scores 428.[41][13] Mexican respondents working in IT scored 559.[12] The [English proficiency guide](https://nearshorers.com/guides/english-proficiency-latin-america) compares all of Latin America.

## How do data protection rules compare?

Mexico replaced its private-sector data protection law on March 20, 2025, and the regulator is now the Anti-Corruption and Good Government Ministry; international transfers can take place without consent in listed cases, including transfers within the same corporate group and transfers needed to perform a contract in the data subject's interest.[42] Colombia's Law 1581 of 2012 prohibits transfers to countries without adequate protection unless an exception applies,[43] and its regulator's list of countries with adequate protection includes the United States.[44]

## How should you choose between them?

Start from the role and the team:

- **Overlap with US Central and Pacific time:** Mexico is one hour closer to the West Coast.
- **Cost at the same salary:** Mexico City's statutory on-cost is lower today, before profit sharing, and rises with the old-age contribution until 2030.
- **English at the national level:** Colombia scores higher, but the strongest cities in both countries score in the same range.
- **Agencies and employers of record:** in Mexico, check the provider's REPSE registration; in Colombia, check that a temporary-staffing arrangement fits the permitted cases.
- **Hours:** Colombia's 42-hour week applies now; Mexico's week falls to 40 hours by 2030.

The [Mexico](https://nearshorers.com/countries/mexico) and [Colombia](https://nearshorers.com/countries/colombia) guides cover each country in full, and the [four-country comparison](https://nearshorers.com/compare/mexico-vs-colombia-vs-brazil-vs-argentina) adds Brazil and Argentina.
